Terms of Service

Article 1 (Application and Purpose)

These Terms of Service (hereinafter referred to as the "Terms") define the conditions for using the mobile application "Zatsmin" (hereinafter referred to as the "Service") provided by us.
The purpose of the Service is to propose a new form of connection in communities and society based on unique metrics related to user interaction.

Users shall register true and accurate information as appropriate when using the Service.
For the purpose of maintaining a safe community, the Service may require the provision of a facial image (selfie) or an official identification document at times such as account creation. As the provided image undergoes special processing, the raw photograph will not be exposed directly to other general users. The provided data, such as images, will be processed and used appropriately for the purposes of generating avatars and other items in the Service, preventing duplicate registrations and unauthorized access, and maintaining the safety, continuity, and functionality of the Service.
The Service has established usage restrictions based on age (18 years or older, etc.) as an eligibility requirement. We will limit the use of the Service by those who do not meet the conditions based on the necessary procedures at the time of registration.
The Service may limit the number of accounts held by the same person, and if we determine that there is a risk of unauthorized use, we may suspend the account or delete the registration without prior notice.

Users shall act with consideration so as not to impair the trust and safety of the community within the Service and in relationships formed through the Service. In particular, treating others with respect, not engaging in discriminatory or exclusionary speech or behavior, and communicating sincerely with respect for diversity are basic matters.
If we determine that a user impairs the soundness of the community or violates these Terms or various rules established by us, we reserve the right to take measures such as limiting part or all of the use of the Service, adjusting or deducting scores, or deleting the account without prior notice.

Various tokens, points, or statuses, such as "mël", issued or granted within the Service are data values provided for the use of functions within the Service, and in no case can they be exchanged or refunded for cash, electronic money, or other economic values outside the Service.
The act of buying and selling such tokens, points, items, etc., through the exchange of money in reality between users (such as real money trading) is strictly prohibited.

Users agree that the data and status generated within the Service will be utilized to improve the accuracy and algorithms of the system, for analysis, and to improve the functions of the Service.
We do not publicly disclose or provide information that directly identifies individuals, such as names and raw message content, to third parties. However, data resulting from the use of the Service may be provided as appropriate to third parties affiliated with us for research and development, system improvement, etc., after undergoing anonymization or processing so that individuals cannot be identified. Detailed handling of data shall be in accordance with the separate Privacy Policy.

While the Service may provide information and functions regarding mutual interactions among users, users shall handle and resolve all actual communication, meetings, negotiations, and any disputes, etc. through the Service under their own responsibility.
We do not guarantee the truthfulness of profiles provided by users or the complete accuracy of identities, and unless there is intentional or gross negligence on our part, we bear no responsibility whatsoever for any disputes or damages arising from the preceding paragraph.

Users must not engage in any of the following acts or acts that may be deemed as such when using the Service.

Any act that violates laws, regulations, these Terms, or public order and morals.
Acts of dishonest registration such as falsifying gender, or acts of using the Service mainly for the purpose of seeking dating partners, deviating from the nature of the Service (the Service is not a service intended for introducing the opposite sex, etc.).
Acts of attempting unauthorized access to our servers, networks, or applications, and any acts that induce unintended behavior or excessive load on the system (including scraping and reverse engineering without our permission).
Real money trading, unauthorized use, and other economic abuses.
Deceptive operations to deceive the evaluation system such as scores, or fraudulent evaluation acts through collusion.
Acts that infringe on the privacy of other users, harassment, stalking, slander, and acts that damage honor.
Acts of collecting, diverting, or recoloring data for commercial purposes, etc. without our explicit prior consent.

When a user or a legitimate right holder believes that their rights have been infringed by information on the Service, they may notify us by explicitly stating the required items through our designated contact point (e.g., email: support@zatsmin.com).
If we investigate the notification in accordance with applicable laws and these Terms and determine it necessary, we may take appropriate measures, such as suspending or deleting the display.

We may change or revise these Terms without prior notice to users if we determine it necessary at our discretion.
The changed or revised Terms shall become effective at the time they are posted within the Service (including the website, etc.), and by continuing to use the Service after the effective date, users are deemed to have agreed to the new Terms.

The interpretation of these Terms shall be governed by Japanese domestic law.
For all legal disputes between us and users related to or arising from the Service, the Tokyo District Court shall be the exclusive agreement jurisdictional court of the first instance.
